1. General
1.1 The terms included in these Standard Promotional Terms & Conditions apply to all promotional offers available through our website, advertisements, social media and other outlets, together with any applicable specific promotional terms and our terms of use, general terms and conditions and privacy policy (collectively the “Rules”), form a legal agreement between you and us and can only be amended with our consent. By participating in any promotion, you are indicating that you accept and agree to be bound by the Rules.
1.2 In relation to some promotions, certain requirements or restrictions must be satisfied, in addition to the general eligibility criteria set out in these Standard Promotional Terms & Conditions, as a condition of being eligible to participate in a promotion. Any such additional restrictions or requirements will be contained or referenced in the applicable specific promotional terms.
1.3 You are urged to check these Standard Promotional Terms & Conditions and any applicable specific promotional terms before participating in any promotion.
1.4 In the event of any inconsistency or conflict between these Standard Promotional Terms & Conditions, any applicable specific promotional terms and our terms of use and general terms and conditions, the specific promotional terms shall prevail, followed by these Standard Promotional Terms & Conditions, but only to the extent necessary to resolve such inconsistency or conflict.
1.5 If these Standard Promotional Terms & Conditions or any applicable specific promotional terms are translated into a language other than English, then the English version shall prevail where there is any inconsistency.
1.6 The Provider of the promotion is Hughie Willett Machinery Ltd, Slade Farm, Slade Lane, Sutton Coldfield, West Midlands, B75 5RP.
2. Promotions and Promotion Periods
2.1 The Provider may, from time to time, run promotions and these may take any form (e.g. special offer, discounts, prize draws, competitions, contests) or a combination of any of these. Full details of a promotion will be set out in the communications The Provider issues to tell you about each promotion (“Promotion Communication”) and/or on the individual webpage for the relevant promotion.
2.2 For the purposes of all promotions, The Provider is the entity you have contracted with under our general terms and conditions (Retail Client Agreement)
2.3 The period of time during which each promotion will run (“Promotion Period”) will be specified in the applicable specific promotional terms. Each promotion will automatically close at the end of the relevant Promotion Period, at which point no further participation in that promotion will be permitted. Where no Promotion Period is specified, the relevant promotion will end when it is discontinued on the website.
3. Promotion participation
3.1 Unless otherwise indicated in the Promotion Communication, participation in each promotion is open to our potential or existing clients but is limited to one per person. The Provider reserves the right to restrict participation in certain promotions to clients or potential clients who fulfil specific selection criteria. Where a Promotion Communication permits multiple participants, The Provider reserves the right, at its sole discretion, to limit the number of participants.
3.2 No employees of Hughie Willett Machinery Limited, its subsidiaries, dealerships and any related or affiliated entities, including advertising agencies, advertisers, sponsors or producers, partners of employees or residents of an employee are able to enter our promotions.
3.3 The Provider reserves the right to run promotions across individual channels, such as on-line only.
3.4 The Provider does not guarantee continuous, uninterrupted or secure access to any Competition page or website. Nor does it accept responsibility for lost, damaged, invalid or illegible entries.
3.5 All entries for a Competition must be received no later than 12.00pm British Time on the End Date to be eligible for selection.
3.6 The prize is personal and is registered in the name of the winner. The prize is not transferable, exchangeable or payable in cash or other products or services. In case of refusal or non-acceptance of the prize or conditions that are inherent to the competition, the prize will not be awarded. In that case, the Provider is entitled to choose another winner.
4 Delivery of Prizes
4.1 The prize is awarded in its current state. The Provider is not responsible for any visible or hidden defects in the prize nor for any damage during delivery (shipping) of the prize.
4.2 The handling of the delivery of the prize is arranged by the Provider, advertiser/sponsor or another appointed third party. In this last case, the Provider is not responsible for the delivery of the prize. In that case, the date of delivery of the prize will be determined in consultation with the supplier of the prize.
4.3 The Provider is not responsible for any defects caused by delivery or shipping companies (e.g. delays, strikes, damage or loss) with respect to the delivery of the prize. When the winner, or a roommate, co-inhabitant or neighbour, isn’t able to receive the prize, the winner will pick up the prize later on (e.g. post office, etc.). The Provider shall not be held liable if the prize is not collected or received by the winner or collected by an unauthorised person, even when the delivery or shipping company has not left any notification or notice in any form.
4.4 If the prize consists of tickets for concerts, festivals, films, sports events or similar types of events and/or holidays/flights, there can be no claim on any form of compensation in case of cancellation.
4.5 If the prize includes travel/accommodation abroad for which a passport is required, the participant must be in possession of a valid passport to receive the prize. The prize is not awarded when failing this condition.
4.6 The winner is able to claim the prize up to three months after publication. After this period, entitlement to the prize automatically expires.
4.7 The winner of the prize gives the Provider permission to use, free of charge, any received personal data, any photos or any contributions linked to the competition to be used in promotional activities relating to the competition and in relation to the announcement of the winner through all media, including radio, television and internet. By entering, you specifically authorise Hughie Willett Machinery Limited, its subsidiaries and any related or affiliated entities, to use your name, voice, images, resemblance, performance taken or registered during the event and to reproduce, edit, diffuse, use and publish these for the sake of publicity, promotion and others in any medium (prints, publicity, internet, video or others) globally and for an unlimited period of time, without any further notification, authorisation or indemnification of any kind.
4.8 The participant consents to the processing of personal data in connection with participation in the competition. The Provider may add the personal information to its database, which is confidential and will be treated in accordance with the Data Protection Act and General Data Protection Regulation.
4.8.1 Your personal information may be transferred to entities belonging to Hughie Willett Machinery Limited as well to marketing services providers working with Hughie Willett Machinery Limited in the UK and/or any other jurisdictions. Data transfers between Hughie Willett Machinery Limited entities and between Hughie Willett Machinery Limited marketing services providers based outside the EU/EEA are governed by data transfer agreements based on European Commission model contracts for the transfer of personal data to third countries to ensure an equivalent level of protection and confidentiality. Collected data is destined to the companies of Hughie Willett Machinery Limited and will not be given or sold to any other companies.
4.8.2 You have a right to access, rectify, erase, restrict the process of your personal data as well as a right to withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal. Unless you withdraw your consent or restrict the process of your personal data will be held and maintained for 10 years by Hughie Willett Machinery Limited for the above purposes you gave your consent for.
4.8.3 Personal information may be used to execute the competition and the award ceremony. In this context, the Provider is entitled to provide personal data to third parties involved in the relevant competition (including suppliers, advertisers, sponsors and/or producers). Moreover, the participant gives permission to the Provider to keep him/her informed of the products and/or services of the Provider, its partners (including sponsors, manufacturers and advertisers) linked with the specific competition entered.
4.9 Use of the awarded prize is at the expense and risk of the winner. The Provider cannot be held liable for use of the prize by the winner under the General and/or specific conditions for competitions.
5. Terms
5.1 To the extent required, the Provider will arrange any withholdings and/or declaration of gambling taxes, except where specific conditions in the competitions state otherwise.
5.2 The Provider is in no way responsible for any damages arising from participation in the competition or for any technical malfunctions, failures or delays with respect to participation in the competition or the appointment of the winner.
5.3 The Provider is in no way responsible for any problems or defects arising from the use of the Website and/or downloading any components whatsoever in relation to the competition.
5.4 The Provider has the right to disqualify participants if it believes that the participants are not acting in conformity with the General and/or specific Terms and Conditions Competitions or if the participant is otherwise fraudulently accessing the competition or unfairly influencing the course of the competition.
5.5 The Provider is entitled to, at its discretion and without notice, change or modify these terms and conditions specific to the competitions for the duration of the contest and without giving a reason to discontinue, modify or adapt the competition for reasons of its own without any obligation to compensate any damages on behalf of the participant. Any changes or adaptations within the competition, will be made public in an appropriate manner (e.g. via its website).
5.6 If one or more conditions of the General and/or specific terms and conditions competitions are void or invalid, this will not affect the validity of the remaining conditions of the General and/or specific Terms and Conditions Competitions.
5.7 The competitions and other promotional activities of the Provider adhere to the Gaming Act and the terms and conditions of the Promotional Gambling Code.
